NOTICE OF MARSHAL’S SALE
PLEASE TAKE NOTICE that in accordance with the provisions of V.I. CODE ANN. tit. 5 § 471 et. seq. and the terms of sale, the undersigned Office of the Virgin Islands Marshal will sell at public sale to the highest and best bidder on the 28th day of February 2020, at 10:00 a.m., at the Office of the Virgin Islands Marshal’s Office, R. H AMPHLETT LEADER JUSTICE COMPLEX, Kingshill, U.S. Virgin Islands, the following real property situated in St. Croix and held in the name of Judgement Debtor FRANK W. DESIMONE to satisfy the Writ of Execution issued out of the Superior Court of the Virgin Islands, Division of St. Croix, on or about December 23, 2019, for Judgment entered on or about February 27, 2018. The below described properties shall be sold as stated herein:
Unit 50 of Long Reef Condominiums, according to the Declaration of Condominium dated January 7, 1988 and recorded in the Office of the Recorder on January 7, 1988 in PC 260 at page 184 as Document 64/9188 together with an undivided 1.29517% undivided interest in the common areas and facilities thereunto pertaining, as set forth in said Declaration.
TOGETHER WITH all of the tenements, hereditaments, and appurtenances thereunto belonging without any representation or guarantee.
The terms of purchase include: ten percent (10%) of the purchase price paid must be deposited with the Marshal’s office on or before 3:00 p.m. on the day of the sale, and, upon failure to do so, the Marshal reserves the right to award the sale to the next highest bidder. The balance of the sum bid must be paid within 30 days, or the deposit will be retained by the Marshal as and for liquidated damages and applied toward satisfaction of the Judgment for which the property is being sold. The Marshal further reserves the right, in such event, to award the sale to the next highest bidder. All payments must be made by cash, certified check, bank check, or U.S. postal order. Personal uncertified checks will not be accepted. This sale is further subject to all other provisions of Title 5, Chapter 43 of the Virgin Islands Code.
