Dec. 19, 2003 – A man who misrepresented himself to security personnel at Cyril E. King Airport last August has been convicted in District Court of identity theft and making related false statements.
A grand jury had indicted Arthur Able on five counts of identity theft, passport fraud, making a false statement, making a false claim to U.S. citizenship and illegally re-entering the United States after deportation.
The trial jury returned a verdict of guilty on each of the five counts, U.S. Attorney David Nissman said in a release.
According to the release, Able, 40, presented a U.S. passport, a Virginia identification card, a Virginia birth certificate and false Customs declaration forms in the name of John Nicholson to Department of Homeland Security inspectors at the airport and subsequently claimed to an FBI agent that he was Nicholson.
"During the course of an investigation, law-enforcement agents discovered that Able had previously been deported as an illegal alien," the release stated.
Nissman said in announcing the conviction that "the United States Department of Justice is committed to ensuring the security of those living within its borders and will not permit those borders to be compromised."
